1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you and [COMPANY/LEGAL NAME] ("DateTrails", "we", "us") governing your use of the DateTrails mobile app and website (the "Service"). You accept them by checking the agreement box when you create an account (or by tapping "Agree & continue" when signing in with a third-party provider). We record the date and the document version you accepted. If you do not agree, do not create an account or use the Service. The Privacy Policy is incorporated into these Terms by reference.
2. Eligibility
The Service is for adults only. You must be at least 18 years old (or the age of majority where you live, if higher) and legally able to form a binding contract. By creating an account you represent that this is true. We may suspend or terminate any account we reasonably believe belongs to someone under 18.
3. Your account
You are responsible for your account and for all activity under it. Keep your credentials secure and notify us promptly of any unauthorized use. You may not transfer or sell your account, impersonate another person, or create an account for anyone other than yourself. You can delete your account at any time in the app (Settings → Delete Account) or via our account deletion page.
4. DateTrails is a planning tool — we do not vet anyone or anything
DateTrails lets users publish and discover date itineraries — multi-stop plans referencing real-world venues and activities. You understand and agree that:
- We do not conduct background checks on any user, and we do not verify the identity, conduct, or intentions of any user.
- We do not inspect, endorse, or verify any venue, location, activity, price, opening time, or other detail that appears in a user-created itinerary. Content may be inaccurate, out of date, or unsafe.
- We are not a party to any interaction between users, or between users and any venue or third party. We are not a dating broker, travel agent, or event organizer.
5. Assumption of risk & meetup safety
Meeting people and visiting places carries inherent risk. You are solely responsible for your interactions with other users and for your decision to visit any location or undertake any activity found on the Service, and you assume all risks arising from them — including personal injury, property damage, and emotional harm — to the maximum extent permitted by law. Use common-sense precautions: meet new people in public places, tell someone where you are going, arrange your own transportation, and never share financial information with someone you just met. If you believe you are in danger, contact local emergency services first, then report the user in-app.
6. Your content & license to us
You retain ownership of the content you create on the Service (itineraries, photos, descriptions, ratings, profile details — "User Content"). By posting User Content you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, adapt (e.g. resize or reformat), publish, and display it for the purposes of operating, promoting, and improving the Service. The license for a piece of User Content ends when you delete it or your account, except for (a) content other users have already shared or interacted with in ways that persist by design (e.g. an itinerary snapshot in another user's completed list), and (b) copies retained briefly in backups or as required by law. You represent that you own or have the necessary rights to everything you post, including the rights to any people identifiable in your photos.
7. Prohibited conduct
We operate a zero-tolerance policy for objectionable content and abusive users. You must not:
- post content that is illegal, hateful, harassing, threatening, defamatory, sexually explicit, exploitative of minors in any way, infringing, or otherwise objectionable;
- harass, stalk, threaten, or harm another user, on or off the Service;
- use the Service to solicit money, advertise commercial services, spam, phish, or run scams (including romance scams);
- scrape, harvest, or collect other users' data, or use the Service with automated agents;
- circumvent, probe, or interfere with the Service's security, rate limits, or access controls, or access it by any means other than the interfaces we provide;
- misrepresent your identity, age, or affiliation.
Users can report content and block other users in-app. Reports are processed primarily by automated systems, which may hide or remove content and restrict accounts; we may also review and act on reports at our discretion. Automated decisions are not guaranteed to be immediate or error-free.
8. Subscriptions, payments & ads
DateTrails offers an optional paid "Premium" subscription. Subscriptions are billed through the Apple App Store or Google Play under their terms, and renew automatically unless canceled at least 24 hours before the current period ends. Manage or cancel in your store account settings — deleting the app or your DateTrails account does not cancel a store subscription. Prices and features are shown in-app before purchase; where a free trial or introductory offer is available, its terms are shown before you subscribe, and it converts to a paid subscription unless canceled before the trial ends. Refunds are handled by the app stores under their policies. Except where required by law, payments are non-refundable. If you are a consumer in the EU/EEA, you have a statutory 14-day right of withdrawal for digital purchases sold at a distance; however, by starting a subscription or trial with immediate access you expressly consent to immediate performance and acknowledge that you lose this right of withdrawal once the service begins. Where the withdrawal right or a statutory refund still applies, it is administered by the app stores as merchant of record. We may change Premium pricing or features prospectively; changes do not affect a period you have already paid for. Free-tier users may see advertisements, including optional rewarded ads.
9. Moderation, suspension & termination
We may remove content, and suspend or terminate your access to the Service, at any time if we reasonably believe you have violated these Terms, created risk or possible legal exposure for us or other users, or where required by law. Moderation may be automated: when you publish or edit a date, the images and text you submit are automatically scanned by third-party safety classifiers, and content may also be reviewed and acted on in response to user reports. Automated systems may hide or remove content and restrict, suspend, or terminate accounts, and are not guaranteed to be immediate or error-free. Where appropriate we will tell you the reason. We terminate the accounts of repeat copyright infringers as described in Section 12 (Copyright policy). You may stop using the Service and delete your account at any time. Sections 5, 6 (surviving license tail), and 10–17 survive termination.
10. Third-party services & links
The Service displays maps, places data, and links provided by third parties, and User Content may link to external sites. We do not control and are not responsible for third-party services, sites, or venues. Your use of them is at your own risk and subject to their terms.
11. Our intellectual property
The Service — including its software, design, branding, and all content we (not users) provide — is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on your personal devices for your personal, non-commercial use. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service except as permitted by law.
12. Copyright policy (DMCA)
We respect intellectual-property rights and respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. If you believe content on the Service infringes a copyright you own or control, send a written notice to our Designated Agent (below) that includes all six elements required by 17 U.S.C. § 512(c)(3)(A):
- a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works);
- identification of the material claimed to be infringing and enough information to let us locate it (for example, the date's URL or the in-app date ID);
- your contact information — name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Counter-notice (17 U.S.C. § 512(g)). If your content was removed or disabled because of a DMCA notice and you believe the removal was a mistake or misidentification, you may send a counter-notice to the Designated Agent that includes: (a) your physical or electronic signature; (b) identification of the material and its location before removal; (c) a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (d) your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the U.S., any district in which we may be found) and that you will accept service of process from the person who filed the original notice. On receipt of a valid counter-notice, we may restore the removed material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
Repeat infringers. We have adopted and will reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers, and we may also remove content and restrict accounts for a single clear infringement at our discretion.
13. Trademarks
"DateTrails", the DateTrails name, logo, and any related marks and trade dress are trademarks of [COMPANY/LEGAL NAME] and may not be used without our prior written permission. Apple, App Store, Google, Google Play, RevenueCat, and other third-party names and logos that appear on the Service are the trademarks of their respective owners; our use of or reference to them does not imply any endorsement, sponsorship, or affiliation.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT ANY CONTENT IS ACCURATE, OR THAT ANY USER IS WHO THEY CLAIM TO BE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [COMPANY/LEGAL NAME] AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE — INCLUDING, WITHOUT LIMITATION, DAMAGES ARISING FROM THE CONDUCT OF OTHER USERS, FROM USER CONTENT, OR FROM ANY INTERACTION, PLACE, OR ACTIVITY UNDERTAKEN IN CONNECTION WITH AN ITINERARY FOUND ON THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF [USD 100] AND THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.
16. Indemnification

17. Dispute resolution & governing law

18. Changes to these Terms
We may update these Terms. Each version is identified by its "Last updated" date above. For material changes we will provide notice in the app and may require you to accept the new version before continuing to use the Service; the version and date of your acceptance are recorded. If you do not agree to an updated version, stop using the Service and delete your account.
19. General
These Terms (with the Privacy Policy) are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any partnership, employment, or agency relationship between you and us.
